The following describes the terms and conditions under which Gala Gloves SRL gives its users access to available services on the website www.galagloves.it.

To enable a complete understanding and acceptance of these terms and conditions, the following terms both in singular and in plural, will refer to the following:
Owner: Gala Gloves SRL with registered office in Via Benedetto Croce 20, Casavatore ( NA) Tel. +39 081 573 24 22, Italian VAT no:  IT04777351216, email address: commerciale@galagloves.it, certified email address: srlgalagloves@pec.it  The website www.galagloves.it  makes provision for the sale of the Owner’s own leather glove production.
Products:  the products and/or services offered on the website
User: a person who may access the website, regardless of the legal nature and purpose of the visit, who may be interested in the products offered on the website
Consumer: a physical person not acting in any commercial or professional capacity
Conditions:  the current contract covers the relationship between Owner and Users with regards to sales and supply via the website.

The purchase of products is concluded following the accurate completion of an order form. This form clearly states all the User and order details,  the price of the product which has been purchased,  any additional charges, the type of payment being made, the shipping address, the delivery lead time, the returns policy as well as the User consent to the privacy policy stipulated.
As soon as the Owner receives the order, the User will receive an order confirmation via email or be sent a printable web summary with all the purchase details above-mentioned.
The conditions are not considered to be effective between the parties in cases of non-compliance with the terms previously indicated.

The Owner may modify or simply update all or some of these terms and conditions.
The User acknowledges and accepts these terms and conditions will be applied to purchase orders created by the User even after the notification of updates/changes are given. At this point the User is invited to revisit and check the terms and conditions once more.

In order to use all the services on the site, the User is invited to register by providing true and complete data required on the registration form. The User is asked to accept both the terms and conditions and the privacy policy. It is the User’s responsibility to keep their login details.
It is understood that under no circumstances will the Owner be held responsible in case of loss, theft or unauthorised use of a User’s login details by a third party in whatsoever capacity.

Gala Gloves Srl does not accept any responsibility regarding the possibility that, due to a particular configuration or any kind of set-up error on the User’s computer, the User should see slight differences in colours of the products shown on the site compared to the original.
The images contained on the website www.galagloves.itare the exclusive property of Gala Gloves who is the official retailer of all its own products.

The purchase of one or more products from the website www.galagloves.it is permitted as much by Users who are actual consumers as by Users who are not.
While we have made every effort to display the colours of the products as accurately as possible, it cannot be guaranteed that these will be reproduced on screen in exactly the same way.
In accordance with Art. 3, paragraph (a) from the Legislative Decree no. 206/2005. (“The Consumer Code”), with regards to the purchase of products, it is understood that consumers are considered to be individuals who are not acting in a managerial, commercial, professional or artisanal capacity.
Purchases are permitted only to individuals who have reached the age of 18 years.
The Owner is committed to describing and presenting the products sold on the website in the best way possible.  Nevertheless, errors or inaccuracies may occur between the website depiction and the actual product.
In addition, any photos or products presented on the site do not constitute any contractually binding elements, in that they are purely representative.
The Owner reserves the right to refuse an order :

  • When a product is not available
  • When the authorisation of payment for the product is declined
  • When, at the time of purchase, a price is shown to be incorrect and is recognised as such.

In this case, the User will be contacted by a Customer Services adviser and will informed about the discrepancy and promptly receive a refund for the transaction.

The owner reserves the right to change product prices and shipping costs at any time.
It is understood that, in the case of the contract between the Owner and User having already been concluded, any changes will not be applied, nor will they affect the purchase terms.
The product sale price includes VAT, where applicable. Any other additional costs, such as shipping costs, will be communicated to the User before the order is confirmed.
The User must agree to pay for the product purchased within the time and manner specified on the site. The expected cost for shipments outside Europe is considered Tax Free. 
Customs duties and local taxes are the responsibility of the User/consumer.
Any refund will be promptly credited to the User, using one of the methods proposed by the Owner and chosen by the User. In the event of exercising the right to return the product within 30 days, the Owner would need to be informed 14 days from receipt of shipment. 
During the SALES period, there are no refunds for products purchased, although the User may exchange or  
replace the product with a similar article, or be offered a voucher of equal value.

For shipments within Italy and the European Union, taxes are included in the prices listed on the website.
For exports and shipments to non-EU countries, additional charges may be incurred due to customs duties or local taxes which are payable by the User.
Please refer to the chart below, indicating costs which are inclusive or exclusive of duties or local taxes depending on the county where the purchase is being made. Any additional costs related to duties or local taxes may be requested by the courier on the day of the delivery.

 The website uses a third party for payment processing who cannot access the User details in any way (credit card number, User name, password etc).
Where such a third party may decline payment authorisation, the Owner shall not supply the products and shall in no way be held responsible for missing or delayed deliveries.

If the User wishes to receive an invoice, they will be asked for their invoice details. 
For billing purposes, the information provided by the User will be considered trustworthy, thereby protecting the Owner from any possible indemnity.

The purchased products will be delivered to the address provided by the User using whichever delivery method was indicated at the time the order was placed.  Delivery will take place within the time specified on the order confirmation. Upon receipt of goods, the User is required to check the state of the delivered product/s based on the order placed; once the goods are checked by the User, the delivery documentation may be signed, unless they wish to decline the goods.

Should the order be out of stock in the warehouse, the Owner will contact the User via email with regards to whether or not more stock will become available and, if so, what the lead times will be and whether they intend to confirm the order on this basis or not.
The Owner does not take any responsibility for delays or missing products which are due to factors outside of its control, such as accidents, explosions, fire, strikes or lock downs, earthquakes or other similar events which may impede, either fully or in part, the delivery of the product within the time frame previously confirmed.

If a Product sold by GALA GLOVES should have a manufacturing defect, or any other fault which does not comply with the Products sold by GALA GLOVES, the customer can immediately search for help on the website and contact either via email to customerservice@galagloves.it, by telephone: +39 081573 24 22 or by post: Gala Gloves SRL, Via Benedetto Croce 20, Casavatore 80020 (NA), Italy.
The sale of the product is subject to legal guarantees declared in Articles 129, 130 & 132 of the Consumer Code defined as:

The User has the right to have the Products brought into line with compliance rules free of charge either by repair or replacement, or, in the case of neither one of these solutions (according to the provisions of Article 130, paragraph 7 of the Consumer Code), to be offered an appropriate discount of the Product(s) cost, or the cancellation of the contract altogether.  These rights may only be guaranteed within two months of the fault being reported to the Owner.  Direct action taken due to lack of conformity not maliciously concealed by GALA GLOVES is recommended, in all cases, within twenty six months from the delivery of the product.

In the eventuality that the User should request, under the terms of Article 13, the repair or replacement of a non-conformity product due to a fault, the costs relating to the return to GALA GLOVES of the product to be repaired or replaced, as with all other costs relating to the delivery to the User of the repaired or replaced product, remain at the Owner’s expense.

These General Conditions, and consequently, the contracts concluded with the client, are regulated under Italian law and must be interpreted on the basis of this law (included in the Legislative Decree n. 206 dated 6th September 2005, the “Consumer Code”, with particular reference to, Chapter I, Title III of Part III as well as the Legislative Decree n. 70 of 9 April 2003, “E-commerce Decree”)

Any disputes arising from the interpretation, validity and/or execution of these General Conditions shall be subject to the mandatory territorial jurisdiction of the competent court at the place of residence or domicile of the Client/consumer.

In all cases, Users have the right to withdraw from the stipulated contract, without penalty and without having to specify any reason, within 14 (fourteen) days from the date of receipt of the purchased goods.
Purchasers wishing to exercise the right of withdrawal must give notice to Gala Gloves by sending an email to customerservice@galagloves.it  After submitting the form, the User will receive authorisation from the Customer Service team to proceed with the return via email, including any eventual costs.
Following authorisation from Gala Gloves Customer Service, within 14 (fourteen) days of the date of receipt of the goods, the User must ship the product/s purchased, suitably protected and packaged where possible in the original packaging, with the original labels and all product accessories (protective envelopes, spare parts, warranty…). The User must use the courier service authorised by the Owner. Within 14 days of delivery, the User may also withdraw from the Sales Contract by returning the item intact, complete with its original packaging. Pursuant to Art. 67, paragraph II of the “Consumer Code”, the substantial integrity of the product to be returned is an essential condition for exercising the right of withdrawal. The products must therefore not have been used, worn, damaged or altered in any way. In any case, the right to a full refund of the price paid is subject to the goods being returned intact and, in any case, in a normal state of conservation including the original labels, which must still be fixed to the garment. If the return conditions laid down in this article are not wholly or partially met, Gala Gloves reserves the right to refuse the return, and therefore has the right to return the Product to the User once payment of all additional shipping costs is received.
Return shipping costs may vary depending on the geographical area where the product is being shipped to. The return cost will be communicated to the User via email as well as an airway bill document to attach to the returned shipment. The cost of the returned shipment remains payable by the User.

Damaged or partially damaged goods, or used products, will not be replaced or refunded. The User has to insert a copy of the delivery note of the goods received inside the box. The right of withdrawal is not applicable in cases where the products have been made to order or clearly personalised.

The website www.galagloves.it is exactly as it is shown, and “how it is available” and the Owner shall not be liable for any implied or explicit warranty regarding the website, nor does the Owner provide any guarantee that the website will satisfy the needs of users or that it will never be interrupted or will be error-free or that it will be free of viruses or bugs.
The Owner will work to ensure that the website is available 24 hours a day without any interruption but will in no way be held liable if, for any reason, the website should be unavailable and/or inoperative at any given moment and for however long a period.
Access to the website may be temporarily suspended and without prior notice in case of system failure, repairs or reasons totally unrelated to the will of the Owner, or in the event of force majeure.

Gala Gloves shall not be held liable for any computer inefficiencies caused by force majeure which may prevent the processing of orders within the time frames laid out in the contract (including, but not limited to, natural disasters or catastrophes, acts of terrorism, strikes, network malfunctions and/or blackouts).
Gala Gloves shall not be liable to the User, except in the case of willful misconduct or serious negligence, for inefficiencies or malfunctions linked to the use of the Internet which are beyond its own control or that of its suppliers.
Moreover, Gala Gloves shall not be held liable for damages, losses or costs borne by the User following the non-implementation of the contract due to causes not attributable to it, as the User only has the right to a full refund of the price paid and any other additional charges incurred.

Under no circumstances shall the User be deemed responsible for delays or with the payment if they can demonstrate that the payment was made within the time frame and with the methods indicated by Gala Gloves

Gala Gloves shall not be held liable for any delays to the receipt of payments which are due to the payment systems managed by third parties, and consequently shall have the right to delay the order confirmation until actual confirmation of receipt of payment.

The images and colours of Gala Gloves products on the e-shop platform may differ from the actual ones due to the settings of the IT system and/or the devices used by the User to view them. Gala Gloves undertakes to correct any errors found in the description of the products offered by the e-shop, in the shortest time possible following reported errors. The contracts made between the e-shop Users and Gala Gloves are governed by Italian law. Specifically, the provisions of Articles 50 and the “Consumer Code” shall apply.
Any disputes concerning the application, performance, and interpretation of these General Conditions of Sale shall be referred to the courts at the place of residence or elected domicile of the User.
Consumers/Users residing in Europe must be aware of the fact that the European Commission has set up an online platform that provides an alternative tool for the resolution of disputes.
This tool can be used by the consumer to resolve any dispute in a non–judicial way relating to and/or arising from the contract purchase of goods and services included in network.
Consequently, the consumer may use the platform for the resolution of any dispute arising from the stipulated online contract between the User and the Owner.
